Enquiry

Upon receipt of the full details of the short term offices to rent questionnaire we will check availability of a suitable office space and provide suggestions. The initial enquiry will be classified as an enquiry only. It is important to note that production spaces will be allocated in accordance with the needs outlines in this first communication.


Provisional Booking


The client must provide us with as much information pertaining to the production. A quote will be generated based on the details in the short term offices to rent questionnaire and the quote will be sent back to the client.


Confirmed Booking

On acceptance of the quote, clients will be expected to pay a deposit as per the deposit requirements. Should this amount not be received in line with the dates stipulated, Dynamic Space has the right to cancel any booking without warning.

Terms and Conditions
 

1. THE CONTRACT
The following terms apply to all bookings made with Cell D (Pty) Ltd, trading as Dynamic Space, 23 First Avenue, Kew, Johannesburg, South Africa. The contract is between Cell D (Pty) Ltd trading as Dynamic Space and The Tenant, and all the persons included in the booking form, named or otherwise. No alteration, consensual cancellation, variation of, or addition of these terms, including this provision, shall be effective unless reduced to writing and signed by both parties.

2. BOOKING AND PAYMENT
This booking is only confirmed after the deposit amount of 50% of the full the booking amount has been paid (see Booking Form), the 20% damages deposit has been received, these conditions are signed and a Dynamic Space confirmation receipt issued.  A refundable damages deposit calculated at 20% of the booking charge, is payable together with the initial deposit, this deposit less deductions will be refunded within 3 days of departure date. If the deposit fails to cover the damages or services, Dynamic Space is entitled to recover any additional costs from you. The prices charged are per day. Unless otherwise stated in the Booking Form. The balance of the full rental amount is to be paid on the day of arrival. The rental does not include stationery, telephone calls, additional data usage, I.T. technical support, meals, personal items, property (personal and business) insurance, collection and delivery services, additional staff hours and services. These conditions are general and may vary; any special arrangements will be in writing and you will be informed of any significant changes.

3. CANCELLATION POLICY
Dynamic Space shall have the right to cancel should the Tenant fail to pay any amount on time. In the event of you wanting to withdraw from these conditions, you must notify Dynamic Space in writing, in which event the following charges will apply:
Cancellation notification received less than 14 days prior to arrival will incur total forfeiture of rental deposit, with the damages deposit returned.

4. GENERAL
In good faith every effort is made by Dynamic Space to provide accurate information, and therefore Dynamic Space shall not be liable for any inaccuracies in its website, prices, other literature, or for any deficiencies, defects or failures in respect of the property. Dynamic Space does not accept any responsibility for any lack of equipment or any failure of the facilities available at the property including the breakdown of any mechanical equipment or for the failure of any public utilities during your stay.

5. PRODUCTION OFFICE SPACE
The property is a production office rental space, and is full of objects d’art, possessions and character and should be treated with due care.
The property shall be used solely for office rental purposes and you are not to allow any activity on the property which is illegal or may render the property’s insurance policies void or voidable.

6. USE OF JOINT FACILITIES AND COMMUNAL AREAS
You have the right to reasonable use, having regard to the rights of other tenants, of all Outer-space areas, Zen garden Space, outside wooden decking, outside toilets and showers, chill lounges and outside patio eating areas. The communal areas are not exclusive to any of the Tenants.

7. SIGNAGE AND ADVERTISING
No signage may be driven, mounted, screwed or fixed to walls or ceilings. No signage may be placed on any of the exterior walls or anywhere on the Property without the consent of the Management of Dynamic Space.

8. MOTOR VEHICLES, TRANSPORT AND PARKING
All motor vehicles, motorcycles and trailers are driven and parked on the premises at the owners or The Tenants own risk. The Tenant shall be liable for any loss or damage arising out of the transportation of any goods by or on behalf of The Tenant in the Building or on the Property.
The Tenant shall not store, display, leave or permit the storage of motor vehicles, motorcycles, packing cases or goods of any nature on the pavement or parking areas outside the Building and shall not place anything in or allow anything to obstruct any entrance, passage or staircase in the Building, nor shall it dump or store in the yard of the Building or anywhere else on the Property or in any lane or access-way adjacent to or used in connection with the Property.

9. MAINTENANCE
The Tenant will prevent any blockage of sewerage and water pipes and drains and remove any obstruction or blockage which is caused.
The Tenant will not dispose of, or leave any refuse anywhere, except in the municipal refuse bins.
No electrical heaters or air conditioners may be installed, connected or used, without the consent of Management of Dynamic Space.

10. OCCUPANCY
Any additional days by which the rental period is extended will be charged at the rate per day figure, as reflected in the Booking Form and paid to Dynamic Space forthwith. The Property is provided only for the use of those persons named. No more than the agreed number of persons is allowed to occupy the property and no refund will be payable in the event of a lesser number of persons occupying the property. Subletting, sharing or assignment is prohibited. In the event the maximum number is exceeded without prior agreement, Dynamic Space reserves the right to increase the daily/weekly/ monthly rental rate. Abandonment of the property or earlier vacation will lead to forfeiture of all rights of compensation. For security purposes, no person will be allowed to enter the building without the correct procedures being followed.

11. STAFF
Cleaning staff are on duty daily, except for Saturday afternoons, Sundays and bank (public) holidays. Duties include the general everyday cleaning of the office space and Property, and includes the cleaning of dishes, crockery and utensils supplied by Dynamic Space. Should you require the staff to work any additional hours or supply services, this can be arranged directly with the management of Dynamic Space, and will be charged for as an additional service. Overtime rates apply for weekends and bank (public) holidays.

12. DYNAMIC SPACE RESPONSIBILITIES

12.1 The property will be made available to you at the agreed dates and times failing which all monies paid will be returned immediately.
12.2 Dynamic Space undertakes to provide all hand towels and other cleaning material for the property.
12.3 Should the Tenant have to be relocated as a result of the property being unfit for occupation, Dynamic Space shall be liable for the costs of re-accommodating the tenant in similar accommodation for the duration of the inconvenience except where the cause is due to tenant negligence.

13. YOUR RESPONSIBILITIES
13.1 You are responsible for the property during your stay and acknowledge that your belongings and those of your crew/staff and visitors are at all times held at your own risk.
13.2 No office item belonging to Dynamic Space can be removed from the Property.
13.3 No smoking is allowed indoors of any of the Spaces, be it offices or bathrooms etc.
13.4 The cost of telephone calls together with all additional services and supplies must be settled within 7 days of date of invoice.
13.5 It is your responsibility to ensure that on leaving the Space, or property unattended at any time during the rental period that the Space and Property is secure, all windows and doors are locked, and the alarm is set.

14. FORCE MAJEURE
Neither you,  the owner, any member of their family, Dynamic Space nor any employee nor agent shall have any claim against any of the others listed herein (see Booking Form) or their crew/staff as a result of any loss or harm suffered by them with regard to this contract as a result of an
event of Force Majeure which may include, but is not limited to war, civil strife or unrest, terrorist activity, strikes or industrial dispute, fire, flood.

15. LAW AND JURISDICTION
The parties hereby consent to the jurisdiction of the Magistrate’s Court of Cape Town, South Africa in respect of all proceedings under or arising out of this agreement.
